A. The director may order a user that has violated, or continues to violate, any provision of this chapter, including a wastewater discharge approval, order or any pretreatment standard or requirement, to appear before the director and show cause why a proposed enforcement action should not be taken.

B. The show cause order shall specify the time and place for the show cause hearing, the proposed enforcement action, the reasons for such action, and a request that the user show cause why the proposed enforcement action should not be taken.

C. The show cause order shall be served personally or by registered or certified mail (return receipt requested) at least 10 days prior to the hearing. Such notice may be served on any authorized representative of the user.

D. A show cause hearing shall not be a bar against, or prerequisite for, taking any other action against the user. [Ord. 2020-07-016 § 1; Ord. 2019-11-032 § 1].
