A. It is unlawful to violate any provision of this chapter, and any such violation shall constitute a civil infraction.

B. Whenever litter dumped in violation of this chapter contains three or more items bearing the name of one individual, there shall be a rebuttable presumption that the individual whose name appears on such items committed the unlawful act of littering.

C. Any person littering in an amount less than or equal to one cubic foot: the maximum penalty and the default amount shall be $50.00, not including statutory assessments; any person littering in an amount greater than one cubic foot: the maximum penalty and the default amount shall be $250.00, not including statutory assessments. Unless suspended or modified by a court, the person shall also pay a litter cleanup fee of $25.00 per cubic foot of litter. The court may, in addition to or in lieu of part or all of the cleanup fee, order the person to pick up and remove litter from the property, with prior permission of the legal owner or, in the case of public property, of the agency managing the property.
