At any time prior to the city council’s final decision on the vacation, the petitioner and city staff may enter into a voluntary agreement containing special terms that would apply to the vacation if the application is approved. These special terms may be included in the draft ordinance vacating the subject right-of-way. City staff will advise the city council of the terms contained in the voluntary agreement. The city council may vacate a street, alley or easement pursuant to such an agreement, subject to the criteria in BMC 13.50.110. [Ord. 2023-09-029 § 2].
