A. The hearing examiner shall hold a public hearing and issue a decision in writing pursuant to Chapter 2.56 BMC and BMC 21.10.120(I).

B. The hearing examiner may approve or approve with modifications and/or conditions an application for preliminary plat after determining that all of the decision criteria pursuant to BMC 23.16.030 above are met. If the proposal does not meet the decision criteria, and/or it cannot be reasonably conditioned to meet the decision criteria, the application for preliminary plat shall be denied.
